Judge Denies Guitar Hero Injunction Filed By The Romantics >

A federal judge has ruled against the band The Romantics, who filed suit against Activision, among others, to prevent them from using their song in Guitar Hero Encore: ROcks The 80s. The Romantics alleged that the game improperly imitates their sound, causing consumers to believe that The Romantics recorded the music and endorsed the product. The judge did not feel the same, and said Activision and Red Octane did everything it was supposed to in order to use the song. The Romantics can appeal, of course.
